M船厂与缅甸D公司交船纠纷

广东民营船厂M与缅甸D公司于2011年9月16日签订《中缅原油管道(缅甸段)船舶采购协议书》,M船厂向D公司出售三条全回转拖轮,2013年5月31日前交船。在合同履行过程中,D船厂交船出现延期,于2013年8月30日正式交船。在交船时,双方代表又签订了拖轮验收《会议纪要》,约定三条拖轮交船后,D船厂需要对遗留项目进行整改,完成后方进行结算。2014年12月5日,停泊在缅甸曼德勒岛码头的一艘拖轮发生船舱进水事故。D公司以船舶存在质量缺陷为由,要求船厂提供无偿修复。但由于船舱进水导致主机故障,修复工作将发生大量费用。M船厂委托我们介入处理,提供专项法律服务。我们通过近1年的跟进处理,协助船厂与船东进行协商谈判,最终船厂的维修费用由船东补偿,同时,船厂顺利收回交船款。

Delivery Dispute between M Shipyard and D Company of Myanmar

Guangdong Private Shipyard M and Myanmar D Company signed the “China-Myanmar Crude Oil Pipeline (Myanmar Section) Ship Purchase Agreement” on September 16, 2011. M Shipyard sold three full-turn tugboats to Company D, and shall deliver them before May 31, 2013. During the performance of the contract, the delivery was postponed to August 30, 2013. At the time of delivery, the representatives of the two parties signed the "Meeting Minutes" for the tugboat acceptance. After the three tugs were delivered to the ship, the D shipyard needed to rectify the remaining projects and complete the settlement. On December 5, 2014, a tugboat accident happened at Mandalay Island, Myanmar. Company D requires the shipyard to provide free repairs on the grounds that the ship has quality defects. However, due to the malfunction of the main engine cause by water, the repair work will incur a large amount of expenses. M Shipyard commissioned us to assist and provide legal services. We assisted the shipyard to negotiate with the owner. Finally, the shipyard's maintenance costs were compensated by the owner. At the same time, the shipyard successfully receive the payment of delivery.
